Terms and Conditions

In accordance with Law 300 of 1996, Decree 53 - January 18, 2002, LIABILITY CLAUSE ON TOUR

PACKAGES

The Ministry of Commerce, Industry, and Tourism is responsible for the products and quality of services described in this program according to the provisions of Law 300 of 1966 and Decree 053/2002. In case of force majeure or fortuitous events, or for reasons not directly attributable to LATINAMERICAN TOURS, the company shall be exempt from contracted obligations.

LATINAMERICAN TOURS is an intermediary company providing tourism services.

Quotations:

  • All our quotations are provided in writing with comprehensive information at the client's request.
  • Quotations do not represent a reservation, nor do they guarantee availability at hotels, circuits, cruises, or any other tourist services.

Reservations:

  • All reservations are made in writing with complete information via email.
  • All reservations include the details of all passengers (full names, identification documents, and dates of birth), especially when individuals of the same sex share rooms.
  • For cruise reservations and South American lake crossings, a scanned copy of the passport biographical page of each passenger must be provided.
  • All reservations must be made with a deposit guarantee, which will be credited toward the total cost of the tour package.
  • LATINAMERICAN TOURS does not accept claims for requests made via telephone.

Rates:

  • All rates listed in our quotations are subject to modifications based on changes and hotel policies.

Airlines and Shipping Lines:

  • LATINAMERICAN TOURS is not responsible for date changes, operational changes at destinations, cancellations, schedule changes, or fare changes by airlines involved in our programs. The airline or shipping line assumes this responsibility.

Hotels:

  • LATINAMERICAN TOURS acts as an intermediary for hotel services. We will act as intermediaries in handling claims and ensure that hotels respond and fulfill requested services. LATINAMERICAN TOURS makes hotel room reservations based on the customer's request. The assignment of rooms is the complete responsibility of the hotel. In most hotels, rooms are normally equipped with either two double beds or one king-size bed; these are subject to confirmation at check-in.
  • Additional beds or cribs in some hotels are available for an additional cost, to be paid by the passenger directly to the hotel.
  • Connected rooms can be requested, but hotels do not guarantee them 100%; they register the request and assign them at check-in if available.
  • If you do not use all prepaid accommodation nights in Colombia for personal reasons, you must request in writing an exemption from the penalty or a refund order from the hotel. This request should be sent to us upon your return so that we can request a refund for the unused nights.
  • If you miss accommodation nights due to flight delays or airline non-compliance during your travel, you should request a refund for those nights from the airline or a written exemption from the hotel's penalty or refund order from us to process the corresponding procedure
  • In most hotels, upon check-in, a credit card guarantee or, if you do not have a credit card, a cash deposit is required for additional expenses, damages, or lost hotel property, and more. Upon checkout, if you did not incur additional expenses or paid in cash, we remind you to request the return of the signed credit card voucher. Remember that a signed credit card voucher is like a bearer check.
  • Hotels may ask guests to leave the premises due to misconduct, and the refund for the following nights is subject to the hotel's established policies for such cases.
  • For telephone calls at hotels, we recommend checking the hotel's rates first or purchasing calling cards.
  • Hotels have established check-in and check-out times. Check-in time is from 14:00 to 15:00 hours. If the passenger arrives before this time, the hotel may accept it at their discretion. Check-out time is from 12:00 to 13:00 hours. If the passenger wants to keep the room later, they should arrange it directly with the hotel. Failure to do so may result in the hotel charging an additional cost or an extra night, according to the hotel's established policies.
  • When selling a Tourist Hotel (3 Stars), it is done upon request based on the client's preference or budget. Therefore, if the service or condition of the hotel is not to the client's liking during their stay, LATINAMERICAN TOURS is not responsible and no refunds will be provided, except for suggestions that will be forwarded to the tourism provider.

Transfers:

  • In case the passenger does not show up at the airport in a timely manner for their respective transfers, it will be considered a no-show. If there is a problem, flight change, cancellation, or delay preventing timely arrival at the airport, it is essential that the traveler communicates and informs the operator, whose information is provided in the vouchers issued by LATINAMERICAN TOURS. If no communication is made, the service will be considered provided, and no refunds will be given.

Force Majeure:

  • LATINAMERICAN TOURS will not be responsible for the failure or absence of service and/or hotel reservations caused by circumstances beyond our control, including acts of God, adverse weather conditions, hurricanes, earthquakes, floods, fires, explosions, war, acts of terrorism, airline strikes, airport strikes, bus company strikes, train strikes, etc., or any other act not directly related to our mediation. In the event that the passenger has reservations in the affected destination and needs to change their destination, city, or hotel, they are responsible for the associated costs. In the event of hurricanes, refunds will be processed 30 days after the event, once we have all the required documentation in our possession. Unused portions will be refunded if applicable by the Hotel/provider.
  • LATINAMERICAN TOURS will not be responsible for the mandatory evacuation of the hurricane-affected area. This is the responsibility of the passenger and the hotel where they are staying, which will suggest alternative accommodations or shelters provided by the city. LATINAMERICAN TOURS will not be responsible for reimbursing any hotel charges, extras, or additional expenses incurred by the passenger due to any of the aforementioned concepts.

Documentation:

  • It is the passenger's responsibility to verify the validity, travel requirements, and all aspects of documentation (passport, visas, travel authorizations, etc.).
  • It is the passenger's responsibility to ensure that the information recorded on the vouchers and tickets provided by LATINAMERICAN TOURS is correctly filled out, including personal information for each traveler (full names, identification documents, and dates of birth).

Requirements:

Consult with the Colombian Migration Office for the following:

  • Required documents for minors leaving the country.
  • Minimum passport validity for leaving the country.
  • Individuals with dual nationality must present a Colombian passport with a minimum validity of 6 months.
  • Check the passenger's immigration status to exit the country
  • Vaccines required for the countries visited during the trip.

Important Information for Boarding and Departure of Minors: Minors traveling without their parents must have a notarized and signed permit from their parents to leave the country. This also applies when a minor is traveling without one of their parents.

We remind you to check with the Colombian immigration office to clarify the information regarding required documents for everyone leaving the country and to clarify passport information.

According to Decree 1514 of July 16, 2012, from the Ministry of Foreign Affairs, Article 21: Modifications. There will be no modifications, corrections, or annotations in travel documents (Passports). In case of any modification or correction in a person's identity, a new travel document (Passport) must be processed.

NOTE: EVERY PASSENGER TRAVELING OUTSIDE THE COUNTRY ACCOMPANIED BY A MINOR MUST OBLIGATORILY CARRY A COPY OF THE MINOR'S BIRTH CERTIFICATE. OTHERWISE, COLOMBIAN MIGRATION WILL NOT ALLOW THE MINOR TO LEAVE THE COUNTRY.

FAILURE TO COMPLY WITH THE REQUIRED DOCUMENTATION FOR LEAVING THE COUNTRY WILL RESULT IN DENIAL OF EXIT FROM THE COUNTRY, AND AS A RESULT, BOARDING WILL BE DENIED, AND 100% NON-REFUNDABLE PENALTY POLICIES WILL APPLY.

Essential for travel: valid mechanical or electronic passport that will not expire within the next 6 months, original ID card, identity card, permission for minors, round-trip tickets, hotel voucher. NOTE: An ELECTRONIC PASSPORT is mandatory for traveling to Europe.

LATINAMERICAN TOURS will not be responsible for damages or losses that may occur.

Changes and Cancellations:

All changes and/or cancellations must be requested in writing. Any charges resulting from changes and/or cancellations are subject to the policies of hotels, airlines, and tour operators. If the passenger departs before reaching an accommodation establishment, the refund will be subject to that establishment's policy.

  • Cancellations made up to 90 days before the start of the trip will incur a penalty equivalent to the deposited amount.
  • Cancellations made 60 days before the start of the trip will incur a penalty of 70% of the total value of the reservation.
  • Cancellations made 40 days before the start of the trip or non-appearance for travel services will incur a penalty of 100% of the total value of the reservation.

Personal Belongings:

  • The passenger is responsible for the care of personal belongings that are lost or damaged anywhere in the vehicle or hotel.
  • LATINAMERICAN TOURS is not responsible for damages or losses that may occur.

Additional Information:

  • Medical Cards and Cancellation Insurance:IT IS RECOMMENDED TO OBTAIN MEDICAL ASSISTANCE AND CANCELLATION INSURANCE FOR ILLNESS, ACCIDENT, OR DEATH.
  • We reject the exploitation of sexual tourism involving children and minors in compliance with Law 678, 679 of 2001, as amended by Law 1336 of 2009.

NOTE: Any changes in government, national, and international taxes must be borne by the client.

IMPORTANT NOTES:

  • QUOTATIONS DO NOT CONSTITUTE A RESERVATION
  • RATES SUBJECT TO CHANGE WITHOUT NOTICE
  • RATES SUBJECT TO AVAILABILITY AT THE TIME OF BOOKING
  • IF THE DATE CHANGES, THE QUOTATION ALSO CHANGES
  • RATES APPLY FOR CASH PAYMENTS – NON-REFUNDABLE TOURS
  • FOR CREDIT CARD PAYMENTS INCREASE BY 3%
  • PLAN QUOTED AT THE CURRENT DOLLAR VALUE (TRM).
  • Responsibility Clauses: applicable to tour packages, circuits, and group departures. The clauses applicable to cruises by the shipping line are provided at the bottom.

    RESPONSIBILITY CLAUSES: (It is essential to read and agree to them before purchasing any tour package).

  • LATIN AMERICAN TOURS with RNT 30393 from the Ministry of Commerce, Industry, and Tourism. In the event of force majeure or unforeseen circumstances, or for reasons not directly attributable to LATIN AMERICAN TOURS, the company will be exempt from obligations. The exploitation and abuse of minors in Colombia are prohibited and penalized by law (Article 16 of Law 679 of 2001).
  • Any reference made in a quotation regarding prices, dates, changes, and availability is subject to itinerary and rate changes until the supplier confirms the reservation in writing.
  • LATIN AMERICAN TOURS and its Operators or wholesalers and/or agents explicitly declare that they act as intermediaries between clients and agencies.
  • LATIN AMERICAN TOURS also explicitly states that it ABSOLUTELY DECLINES any responsibility for refunds for any service not provided due to circumstances beyond our control, such as strikes, hurricanes, decisions by location management, immigration decisions, and any other case of force majeure that may occur before and during the trip. The risks and hazards of the trip belong exclusively to the passenger.
  • LATIN AMERICAN TOURS is exempt from all responsibility in cases such as flight cancellations or delays, changes in flight itineraries, overbooking, airport closures, road closures, tourist site closures, whether due to climate change or management decisions, and all activities unrelated to the direct management of the program or modifications in the traveler's benefit.
  • LATIN AMERICAN TOURS and its suppliers will be released from contracted obligations when there are force majeure causes or circumstances beyond the control of the party invoking them, abnormal and unforeseeable circumstances whose consequences could not have been avoided despite all due diligence, or sufficient causes that encompass those situations in which, despite LATIN AMERICAN TOURS and its suppliers acting with due foresight and diligence, they cannot provide the contracted services for reasons that are not directly attributable to them in accordance with current legislation.
  • LATIN AMERICAN TOURS and its suppliers are not responsible for accidents suffered by a passenger at the travel destination; it is necessary for the passenger to purchase additional travel insurance (some travel plans do not include accident insurance). Therefore, the passenger must verify whether the plan being purchased includes it or, if not, acquire it additionally.
  • LATIN AMERICAN TOURS and its suppliers are not responsible for baggage and any items carried by the user.
  • LATIN AMERICAN TOURS and its suppliers have the right to modify the itinerary or hotels that make up a tour or excursion and other services, to others of equal or superior quality, when these changes benefit the quality of the trip without prior notification or authorization from the user.
  • LATIN AMERICAN TOURS and its suppliers have the prerogative to remove from the trip any person who, due to a serious moral or disciplinary reason duly proven, threatens the success of the trip. In this case, the user will be entitled to a refund of the value of the unused tourism services, except for the expenses actually incurred, and the penalties charged by the suppliers will be deducted, without any responsibility on the part of LATIN AMERICAN TOURS.
  • The agency will not assume any responsibility regarding legal matters or other inconveniences in which the user may be involved if the user is forced to leave the excursion or tour due to such reasons, and likewise, regarding personal expenses incurred by the passenger.
  • Once travel documents are delivered to the passenger, they will be under the passenger's custody; the agency no longer has responsibility for them.
  • LATIN AMERICAN TOURS and its suppliers, to guarantee a group departure, whether national or international, require a minimum number of passengers for each program. If the minimum number of people required for the program is not met, the passenger will be given the option to change the date or receive a full refund of the amount paid for the tour package.
  • The passenger who, for any personal reason, whether out of necessity, caprice, illness, or simply being off-schedule and DOES NOT take any service, will not be entitled to any refund. All passengers must have the corresponding documentation in order, in accordance with the laws of the countries to be visited. It is the passenger's obligation to obtain such documentation on their own. In the event that LATIN AMERICAN TOURS is responsible for providing assistance in obtaining a visa, it will not assume responsibility if the authorities of the country or countries visited deny the passenger the required documents for entry (visa). In this event, the user will be entitled to a refund of the deposit left for the unused tourism services, depending on the policies of the selected suppliers for the purchased plan.
  • DEPOSIT and PAYMENTS: 50% is required for national and international reservations, hotels (NON-REFUNDABLE). The full 100% cancellation for national plans must be done 20 days before the travel date, and the full 100% cancellation for international plans must be done 30 days before the travel date.
  • HOTEL DAY: Hotel policies regarding check-in and check-out times are accepted, typically checking in at 3:00 PM and checking out at 12:00 PM (regardless of flight schedules).
  • After payments, confirmations, or issuance of services, or in the event of a total cancellation of the tour and/or services contracted by the passenger for any reason, including illness and/or death, the following cancellation penalties apply, based on the total value of the plan:
  • Deposits are non-refundable.
  • From 01 to 15 days: 100% of the plan value
  • From 16 to 29 days: 70% of the plan value
  • 30 days or more: 30% of the plan value
  • No show (missed flight): 100% of the plan value
  • Changes or revisions (subject to airline charges).
  • Once the tour has started, the non-use of any service or abandonment of the tour will not be eligible for any refund.
  • Any traveler or client who purchases a tour or travel package offered by LATIN AMERICAN TOURS acknowledges and accepts all the conditions of exoneration of responsibility presented here.
  • Similarly, the passenger must be aware of all the epidemic control measures that must be complied with to travel to their destination.
  • CRUISE LINE PENALTY CLAUSES FOR CRUISES

    PENALTY POLICIES FOR CANCELLATION OF CRUISE RESERVATIONS – DEPOSIT TO BOOK – USD 350 – NON-REFUNDABLE

  • Any cancellation made within 90 days prior to the embarkation date will incur a penalty of USD 60 in expenses per canceled person (from 2 years old) USD 40 for the cruise line and USD 20 in administrative expenses for LATIN AMERICAN TOURS.
  • Any cancellation made between 60 and 41 days prior to the embarkation date will incur a penalty of 33% in expenses on the total value of the services purchased.
  • Any cancellation made between 40 and 30 days prior to the embarkation date will incur a penalty of 67% in expenses on the total value of the services purchased.
  • Any cancellation made within 29 days prior to the embarkation date will incur a penalty of 100% in expenses on the total value of the services purchased.
  • If the initially booked passengers cannot travel and wish to make a name change, only 1 change per cabin is allowed with a minimum of 40 days before departure, applying the current price in the cruise line's reservation system at the date of the change, and the penalty for this change by the cruise line must also be assumed.
  • In the event of eventual cancellation or no show (failure to embark), passengers agree to pay the cancellation charges outlined in this document.
  • There are no refunds for cruise cancellation due to force majeure, accident, air connections, legal issues, and climate problems, as LATIN AMERICAN TOURS and PULLMANTUR recommend taking cancellation insurance.
  • Once the reservation is confirmed, the passenger must be aware of the program's policies and conditions, and must declare that they have read and accept in all their parts and without exception, the prices, payment conditions, and cancellation policies.
  • PAYMENT CONDITIONS

  • The first deposit must be made according to the date given in the reservation confirmation, keeping in mind that if it is not made, the system will cancel the cabin and it cannot be guaranteed. To book, a deposit of USD 350 per person must be paid (NON-REFUNDABLE).
  • The cancellation of 100% of the cruise value for the Horizon Ship must be made 2 and a half months before the travel date, and for the Monarch Ship, it must be made 3 months before the travel date. If not cancelled by the stipulated dates, the cruise line may cancel the cabin and apply the penalties outlined in the upper part of this document.
  • SPECIAL POLICIES FOR RESERVATION

  • A photocopy of the passport is required to make the reservation with the cruise line. (the passenger must ensure that the passport is valid, with 6 months validity before the travel date).
  • Yellow fever vaccination.
  • Minors under 18 years old traveling without their parents must have a signed and authenticated boarding permit.
  • The deposit with these policies and the total payment on the dates indicated in the confirmation are required; otherwise, your reservation will be automatically cancelled and the applicable penalties will be charged.
  • LATIN AMERICAN TOURS is not responsible for cancellations and penalties generated due to non-compliance with documentation and payment policies, and at any time the cruise line reserves the right to cancel cabins due to lack of payment or documentation.
  • NOTE: Visa conditions are the prerogative of countries and can be changed unilaterally by each country at any time, and the cruise line is not responsible for this situation.
